Creates a truancy pre-trial diversion program allowing parents, guardians, and custodians of truant children to avoid conviction by remedying the truancy and its underlying causes within 6-18 months.

Removes criminal penalties for students 18 years or older who fail to attend school, shifting accountability solely to parents/guardians of minors under 18.

Requires magistrate and circuit court judges to delay sentencing for at least 90 days after a guilty plea to allow defendants to demonstrate improved school attendance.

Authorizes courts to order the Department of Human Services to provide home-based family preservation services to address root causes of truancy such as mental health issues, substance abuse, or parenting skills.

Reduces fines from $50-$100 to $5-$50 for defendants who substantially comply with the 90-day delay requirements, and allows dismissal of charges if children maintain full attendance during that period.
