Pending building permit and land use applications remain under county jurisdiction when land is annexed by a city or town, rather than immediately transferring to the municipality

County retains authority to issue or deny the application, with jurisdiction transferring to the annexing city or town only after the county makes a final decision

Counties are prohibited from arbitrarily or capriciously denying applications solely to transfer jurisdiction to the annexing municipality

Applies to annexations and permit applications filed on or after July 1, 2026

Effective date: July 1, 2026
