County memorial hospitals and hospital districts may now file for bankruptcy under Chapter 9 of the United States Bankruptcy Code as an alternative to dissolution and termination.

County memorial hospital bankruptcy filings require approval of the bankruptcy petition and initial debt adjustment plan by the board of county commissioners before becoming effective.

Hospital district bankruptcy filings do not require a vote of qualified electors, but the petition and debt adjustment plan must be posted publicly on the district's website for at least 7 days before the first public meeting where trustees consider the filing.

Upon approval, trustees may take all actions necessary to obtain confirmation of the debt adjustment plan and close the bankruptcy case under Chapter 9.

Effective immediately upon completion of all acts necessary for the bill to become law.
