Registered sex offenders age 18 or older are prohibited from residing within 1,000 feet of child care facilities, measured from the offender's dwelling to the facility's property line.

The restriction does not apply if the offender's residence was established before July 1, 2026, or before the child care facility opened at that location.

"Child care facility" includes facilities licensed by the Department of Family Services and government-operated child care programs, but excludes elementary, middle, and high schools.

The state division must verify offender addresses against child care facility locations and, upon request, determine whether a proposed address complies with the 1,000-foot requirement.

The division must notify child care facilities within 1,000 feet when certain sex offenders register nearby. Effective date: July 1, 2026.
