Legislative approval required before construction of industrial-scale generation facilities (150+ megawatts capacity, wind projects 5,000+ acres, solar projects 500+ acres) and large industrial power loads (75+ megawatts single site, 100+ megawatts aggregated)

State agencies prohibited from allocating state funds (grants, loans, tax incentives, bonds) of $200,000 or more for any energy project without specific legislative approval identifying project details, funding sources, and ratepayer protections

Public utilities not required to serve large industrial power loads but may do so with legislative approval

Exceptions granted for emergencies declared by the Public Service Commission when energy capacity is insufficient, and for routine maintenance or upgrades below the defined thresholds

Effective July 1, 2026, applying to projects seeking state action on or after that date, with existing contracts unaffected
