Local governments become liable for damages caused by failure to reconstruct or maintain bridges, culverts, highways, roadways, streets, alleys, sidewalks, or parking areas, including weather-related maintenance failures

Claimants must prove the infrastructure needed repair so significant that a reasonable person would foresee likely damage, and must have provided written notice to the local government before damages occurred

Local governments avoid liability if they took "reasonable steps" after receiving notice, such as developing plans, entering contracts, or beginning reconstruction/maintenance work

The state and state agencies remain excluded from this liability waiver; only local governments are affected

Effective July 1, 2026, applying to claims arising from incidents occurring on or after that date
