Towing services. Amends the statute concerning the release of an abandoned motor vehicle that has been towed to a storage yard or towing facility as follows: (1) Provides that a towing service or storage yard may charge an inspection fee for inspections or retrievals from a vehicle. (2) Requires a towing service or storage yard to: (A) provide an itemized receipt upon payment; and (B) meet certain requirements as to: (i) hours of operation; and (ii) receiving and returning telephone calls. Provides that not later than three business days after towing a vehicle a towing company or storage facility must comply with certain statutes relating to abandoned vehicles for giving notice. Requires a towing company to charge reasonable fees. Requires a towing company to provide the owner or operator of a motor vehicle that is about to be towed a written and itemized estimate of all charges and services to be performed by the towing company. Requires a towing company to document and itemize certain fees related to a tow and certain towing services. Specifies certain record keeping requirements for itemized estimates issued by a towing company. Creates a new article in the Indiana Code to establish certain requirements for towing companies that engage in, or offer to engage in, the business of providing towing service in Indiana, including provisions concerning the following: (1) Emergency towing. (2) Private property towing. (3) Releasing towed motor vehicles. (4) Prohibited acts by towing companies and storage facilities. Provides that a person who violates these new provisions commits a deceptive act that is: (1) actionable under; and (2) subject to the penalties and remedies set forth in; the statute governing deceptive consumer sales. Provides that the attorney general: (1) shall receive, and may investigate, complaints alleging violations of the new provisions; and (2) after finding that a violation has occurred, may take appropriate action under the statute governing deceptive consumer sales. Authorizes the attorney general to adopt rules to implement the new provisions.
Dealer services. Provides that a broker is not defined as a lead generation or other marketing service except in certain instances. Defines "dealer owner" for a business entity. Moves certain provisions providing temporary license plates and dealer plates to the dealer services law. Removes the requirement that a person must be licensed by the secretary of state before the person may possess for more than 30 days more than two inoperable motor vehicles. Provides that an automotive salvage recycler must be licensed by the secretary of state before the automotive salvage recycler may do certain activities. Requires that an automotive salvage recycler must report a purchase of a motor vehicle to the National Motor Vehicle Title Information System within 72 hours. (Current law requires 30 days.) Requires an automotive salvage recycler to allow the secretary of state, a police officer, or an agent of the secretary of state to inspect a certificate of authority. Changes the composition of the motor vehicle sales advisory board (board). Allows the board members to be reappointed. Requires that a zoning affidavit or statement be signed not more than 90 days before the affidavit or statement is submitted to the secretary of state as part of an application for various permits and licenses. Requires a dealer to submit an application for approval of a change to a dealer manager. Removes the provision providing for a manufacturer or distributor to recover costs under a uniform warranty reimbursement policy in certain instances. Requires a copy of a contract between a manufacturer or distributor and a franchisee be provided to the secretary of state. (Current law requires that the copy be submitted to the bureau of motor vehicles.) Makes conforming changes. Makes technical changes.
Offenses involving critical infrastructure. Repeals the term "key facility" and replaces it with "critical infrastructure facility". Defines "critical infrastructure facility". Provides that a person who, not having a contractual interest in the property, knowingly or intentionally enters the real property of a critical infrastructure facility without the permission of the owner of the critical infrastructure facility or an authorized person commits the offense of critical infrastructure facility trespass. Provides that a person who recklessly, knowingly, or intentionally damages or defaces property of a critical infrastructure facility commits the offense of critical infrastructure facility mischief. Provides criminal penalties and civil remedies
Peer to peer vehicle sharing. Defines peer to peer vehicle sharing. Provides requirements for a peer to peer (P2P) vehicle sharing program. Provides that a shared vehicle may not be shared on a peer to peer vehicle program if any safety recalls have not been repaired. Provides insurance requirements for a shared vehicle if the vehicle will be shared on a peer to peer vehicle sharing program. Provides that a P2P vehicle sharing program is responsible for maintaining liability insurance coverage during the car sharing period for a vehicle shared through the P2P vehicle sharing program. Provides that a P2P vehicle sharing program shall assume liability of a shared vehicle owner for any bodily injury or property damage to third parties or uninsured and underinsured motorist losses during the car sharing period in an amount stated in the car sharing agreement, which may not be less than the minimum amount set forth in the financial responsibility statute. Provides that the bureau of motor vehicles may not suspend the driving privileges of a shared vehicle owner for failure to submit proof of financial responsibility at the time an accident occurred if the vehicle was shared through a peer to peer vehicle sharing program at the time the accident occurred. Provides that a political subdivision may not enact or enforce an ordinance, resolution, policy, or rule to regulate peer to peer vehicle sharing. Allows the board of an airport authority or a board of aviation commissioners to enact or enforce an ordinance, resolution, policy, or rule regulating P2P vehicle sharing.
Information concerning threats to school safety. Permits a law enforcement agency or private university police department to share private investigatory records with a school corporation, charter school, or nonpublic school for the purpose of enhancing the safety of a student or school facility, without losing the discretion to keep the records confidential from other records requesters. Provides that a school corporation or other entity to which the education records privacy provisions of the federal Family Educational Rights and Privacy Act apply may disclose or report on the education records of a child, including personally identifiable information contained in the education records, without the consent of the child's parent to appropriate officials in cases of health and safety emergencies as determined by school officials. Provides immunity from civil liability concerning the disclosure or report of education records of a student. Provides that in the case of a health or safety emergency, a law enforcement officer shall disclose or report a child's personally identifiable information contained in law enforcement records to a school corporation or an appropriate official. Provides that information concerning any suspicious activity or potential criminal activity related to a child that is shared between a law enforcement officer and a school corporation or an appropriate official shall not be stored or maintained in any type of data base.
Subscription auto sales. Extends the subscription program prohibition to May 1, 2020. Provides that effective July 1, 2013, a document preparation fee in excess of $200 is an unfair practice. Specifies certain disclosure requirements concerning document preparation fees. Makes conforming amendments.
Building standards. Removes language that relates to the temporary rules and regulation of sanitary conditions and sanitary facilities of Class I structures. Adds certain elevator standards to the list of national codes, or their equivalent, that the fire prevention and building safety commission (commission) shall adopt to comply with the statewide code of fire and safety building laws. Removes the requirement that the commission shall adopt the most recent edition, including addenda, of ASME A17.3 (Safety Code for Existing Elevators and Escalators, an American National Standard). Allows the department of homeland security (department) to request certain types of documentation to determine that work conducted on a regulated lifting device was performed by a licensed individual. Requires the commission to adopt national codes within 24 months after the effective date of the national code. Provides that the commission may not adopt an amendment to a national code if the amendment will unreasonably impair safety. Allows the commission to set a fee that is less than the standard fee for certain permits if the acceptance inspection is performed by an inspector that is not employed by the department. Requires an individual who is renewing an operating certificate to submit all safety test results when making application for the renewal operating certificate. Removes obsolete sections. Makes conforming changes.
Performance and payment bonds. Provides that for public-private BOT agreements, public-private agreements for toll road projects, and public-private partnership agreements for transportation projects entered into after June 30, 2019, a performance bond must be for not less than 50% of the cost to design and construct the project and a payment bond must be for not less than 100% of the cost to design and construct the project.
Electric bicycles. Defines the term "electric bicycle" as a bicycle equipped with: (1) operable pedals; and (2) an electric motor with a power output not greater than 750 watts. Provides that an electric bicycle is not a motor vehicle. Provides that the operator of an electric bicycle is: (1) subject to all of the duties; and (2) entitled to all of the rights and privileges; of a bicycle operator. Provides that an electric bicycle shall be regulated as a bicycle. Provides certain exceptions. Exempts the operator of an electric bicycle from motor vehicle statutes concerning: (1) driver's licenses; and (2) financial responsibility. Exempts electric bicycles from motor vehicle statutes concerning: (1) certificates of title; (2) registration; and (3) off-road vehicles. Requires manufacturers and distributors of electric bicycles to affix and prominently display a label with the following information on each electric bicycle: (1) The class level of the electric bicycle. (2) The top assisted speed of the electric bicycle. (3) The total power output of the electric bicycle's electric motor. Requires all electric bicycles to comply with certain requirements adopted by the United States Consumer Product Safety Commission. Requires all electric bicycles to be equipped with an electric motor that disengages or ceases to function when the operator: (1) stops pedaling; or (2) applies brakes. Specifies where electric bicycles may be operated. Allows a local authority or state agency with jurisdiction over a trail, bicycle path, or multipurpose path to regulate the use of electric bicycles on a trail, bicycle path, or multipurpose path subject to the local authority's or state agency's jurisdiction. Prohibits a person less than 15 years of age from operating certain electric bicycles. Allows a person less than 15 years of age to ride as a passenger on certain electric bicycles. Requires a properly fitted and fastened helmet capable of meeting certain safety standards to be worn by certain individuals when operating or riding on certain electric bicycles. Requires the operator of a motor vehicle to provide at least 3 feet of clearance when passing or overtaking an electric bicycle in certain instances. Defines certain terms. Makes conforming amendments.
Bureau of motor vehicles. Provides that if one or more of the following taxes have not been paid for one or more preceding years, the bureau of motor vehicles may collect only the tax for the year immediately preceding the current registration year, the current registration year, and the year immediately following the current registration year: (1) The county vehicle excise tax. (2) The county wheel tax. (3) The municipal vehicle excise tax. (4) The municipal wheel tax. (5) The motor vehicle excise tax. (6) The recreational vehicle excise tax. (7) The commercial vehicle excise tax. (8) The boat excise tax. Specifies to which vehicles a county vehicle excise tax, county wheel tax, municipal vehicle excise tax, and municipal wheel tax apply. Provides that an owner who has paid a surtax or wheel tax and moves out of state may be entitled to a refund. Specifies the minimum and maximum vehicle registration periods for a vehicle with an: (1) expired; and (2) unexpired; registration. Requires that all copies of all ordinances that impose, rescind, or change the rate or amount of a surtax or wheel tax be submitted in a manner prescribed by the bureau of motor vehicles (bureau). Provides that the maximum design speed for a low speed vehicle is 25 miles per hour. (Current law provides for 35 miles per hour.) Provides that, in certain instances, off-road vehicles and snowmobiles need to be registered. Provides that, during the registration or registration renewal process, the bureau may provide information concerning a manufacturer issued motor vehicle safety recall to the registered owner of a motor vehicle subject to an ongoing recall. Specifies that the bureau may not charge a fee for providing information concerning an ongoing, manufacturer issued safety recall. Provides that: (1) the bureau; (2) the commissioner of the bureau; (3) employees of the bureau; and (4) third party vendors responsible for providing the bureau with manufacturer issued safety recall information; are immune from civil liability for any act or omission related to the bureau providing safety recall information. Provides that a person may transfer a plate from a wrecked or destroyed vehicle to a vehicle acquired or owned by the person. Removes the provisions providing for a probationary period for independent colleges under the special group recognition license plate program. Provides that the Indiana department of transportation must review plans for general vehicle platoon operations. (Current law provides that the commissioner of the bureau must review plans). Specifies that an individual who is 75 years of age or older may renew an operator's, chauffeur's, or public passenger chauffeur's license by mail or electronic service if the individual provides proof of an eyesight examination with the renewal application. Establishes distribution by percentage of fees paid for reinstatement of driving privileges. Specifies that a court may waive part or all of a reinstatement fee for driving privileges. Removes the requirement that an emergency contact for the purposes of the emergency contact data base must hold a valid credential. Requires an individual seeking a license to be a driver education instructor to be currently employed or have an employment offer from a licensed driver training school. Requires a rider coach trainer to meet standards established by the bureau for instructors in motorcycle safety and education. (Current law requires that the standards be equivalent to or more stringent than those established by the Motorcycle Safety Foundation.) Requires an applicant from a foreign country that has a reciprocity agreement with the bureau for obtaining an operator's license to possess a valid driver's license for the type of vehicle being operated or the equivalent from the foreign country. (Current law also allows the applicant to possess an international driving permit.) Specifies that the court may grant driving privileges to an individual whose driving privileges have been suspended for life: (1) for a specified period of time; and (2) subject to certain conditions. Requires an individual who has been granted driving privileges through a court order after the individual's driving privileges have been suspended for life to possess the order when operating a vehicle or produce the order upon request of a police officer. Provides that the bureau of motor vehicles may waive certain testing requirements for an applicant seeking a learner's permit or a driver's license in certain instances. Provides that the bureau of motor vehicles (BMV) may develop a system to issue mobile credentials. Provides that the BMV may issue, upon request of an applicant, a mobile credential when the applicant satisfies the requirements for application for an identification card or various licenses and permits. Provides the BMV with rulemaking authority to implement the mobile credential system. Defines mobile credential. Eliminates both the department of natural resources fee and the lake and river enhancement fee. Sets out the registration and renewal fees for motorboats. Makes conforming changes.
Disposal of abandoned or derelict aircraft. Specifies that a "person" includes a political subdivision for purposes of the statute concerning liens for the repair, storage, servicing, or furnishing of supplies for certain motor vehicles, airplanes, machinery, and equipment. Establishes a procedure for the disposal and removal of an abandoned aircraft or a derelict aircraft from the premises of: (1) a public-use airport; or (2) a fixed-base operator at a public-use airport.
Department of homeland security. Provides that the fire prevention and building safety commission will adopt rules for regulated boiler and pressure vessels. (Current law provides that the boiler and pressure vessel rules board adopts rules for regulated boiler and pressure vessels.) Provides that the division may conduct a program of inspections of regulated boilers and pressure vessels. (Current law provides that the division shall conduct a program of periodic inspections of regulated boiler and pressure vessels.) Provides that the division shall: (1) issue a regulated boiler and pressure vessel operating permit to certain applicants; (2) perform operating permit inspections of a boiler or pressure vessel owned by the state; (3) conduct a program to audit boiler and pressure vessel inspectors; and (4) conduct a program to audit inspections completed by a boiler and pressure vessel inspector. Provides requirements for qualifying or renewing an operating permit. Removes requirements for inspections. Provides the fire prevention and building safety commission (commission) with emergency rulemaking authority to adopt rules concerning the division's inspection program. Removes provisions in the Indiana Code concerning inspection agencies. Provides that the commission may sanction a boiler and pressure vessel inspector in certain instances. Removes provisions in the Indiana Code concerning owner or user inspection agencies. Allows members of police and fire departments to reside within a county that is noncontiguous to the county where the police or fire department is located but is not more than 50 miles from the closest boundary of the city, town, or township where the police or fire department is located. Includes an emergency management worker and a division fire investigator in the definition of "public safety officer" to qualify the person for the special death benefit for a public safety officer who dies in the line of duty.
Student mental health. Adds additional purposes for which matching grants made under the Indiana secured school fund (fund) may be used. Amends the uses relating to school security for which the fund may be used. Establishes the student and parent support services grant program. Urges the legislative council to assign to an appropriate interim study committee the task of studying school districts, within and outside of Indiana, that have: (1) implemented trauma informed approaches in the school districts; and (2) worked with community partners to provide systems of care for students.
Electric foot scooters. Provides that an electric foot scooter is not a motor vehicle for purposes of certain motor vehicle laws. Provides that an electric foot scooter has all rights and duties that apply to a person operating a bicycle. Exempts electric foot scooters from financial responsibility. Provides for certain equipment requirements for electric foot scooters. Allows an electric foot scooter to be parked on a sidewalk in certain instances. Prohibits an electric foot scooter from operating on an interstate highway. Provides that a local authority, with respect to private roads and highways under the authority's jurisdiction, may regulate the standing or parking of electric foot scooters. Provides that a local authority, with respect to private roads and highways under the authority's jurisdiction, may regulate the operation of electric foot scooters and require the registration and licensing of electric foot scooters. Makes conforming changes.
Vehicle weight. Allows the Indiana department of transportation and certain local authorities to issue a permit that allows for the transportation of: (1) material; (2) products; or (3) equipment; belonging to an electric cooperative in certain instances. Urges the legislative council to assign to an appropriate interim study committee the task of studying overweight divisible loads. Urges the legislative council to assign to an appropriate interim study committee the task of studying: (1) the use of automated traffic control systems in work zones; and (2) the use of special signaling devices on construction vehicles in critical work zones.
Survivor health coverage. Provides that, if the employer of a public safety officer who dies in the line of duty after June 30, 2019, offers health coverage for active employees, the employer shall offer to provide and pay for health coverage under the plan covering active employees for the surviving spouse and each natural child, stepchild, and adopted child of the public safety officer. Provides that health coverage for a surviving child continues: (1) until the child becomes 18 years of age; (2) until the child becomes 23 years of age, under certain circumstances; or (3) during the entire period of the child's physical or mental disability; whichever period is longest. Changes the application date from a death occurring after June 30, 2019, to a death occurring after December 31, 2017. Requires the department of local government finance to establish a state address confidentiality form to be used to restrict access to the home address of certain persons. Adds to the definition of "covered person" the surviving spouse of a covered person if the person is killed in the line of duty. Provides that the state address confidentiality form may be used when applying for address confidentiality.
Bunkhouse safety requirements. Defines "bunkhouse". Provides that, before January 1, 2021, the commission may adopt rules to exempt bunkhouses from being required to be equipped with an automatic fire sprinkler system.
State police supplementary death benefit. Provides that the state police department may not use a deceased employee beneficiary's retirement date with the department as a factor in determining the amount of the deceased employee beneficiary's supplementary death benefit.
Grants from state disaster relief fund. Provides that the maximum amount that an individual may receive from the state disaster relief fund (fund) as compensation for damages to the individual's property is $10,000. (Current administrative rules provide that the maximum amount is $5,000.) Voids provisions in the Indiana Administrative Code that set forth a maximum compensation amount of $5,000. Directs the department of homeland security to amend, before July 1, 2020, the administrative rule concerning the fund to reflect a maximum compensation amount of $10,000 for individuals.
Telephone CPR instruction training. After July 1, 2020, requires an individual to complete a telephone cardiopulmonary resuscitation (T-CPR) training program (program) approved by the division of fire and building safety (division) if the individual: (1) answers 911 emergency medical telephone calls for a state or local law enforcement agency or fire protection agency, including a volunteer fire department (agency); and (2) is authorized by the agency's protocols to provide T-CPR instructions to a caller. Provides that the division may provide programs or third parties may provide programs that are approved by the division. Requires the division to: (1) adopt minimum standards for programs that meet or exceed evidence based nationally recognized emergency cardiovascular care guidelines; and (2) establish continuing education requirements. Allows the division to collect reasonable fees for providing programs and certifications that are deposited in the fire and building services fund. Sets forth certain requirements for a public safety answering point if a public safety answering point transfers a telephone caller to a public safety telecommunicator. Provides that a public safety telecommunicator who has completed a certified training program in emergency medical dispatch call handling is exempt from completing a T-CPR training program. Provides civil immunity for damages relating to the provision of T-CPR instruction. Makes a technical correction.
Safe schools. Provides that school corporations, charter schools, and accredited nonpublic schools with the sheriff for the county in which the school corporation, charter school, or accredited nonpublic school is located, may apply for a grant from the Indiana secured school fund to provide for the initial set up costs for an active event warning system. Requires guidelines published by the department of homeland security to include information about implementing: (1) universal electronic access to school property for law enforcement in all schools within each county; and (2) access to closed circuit cameras from a central location to be used in an emergency situation.
Privacy and tracking of rape kits. Provides that a hospital or licensed medical services provider that provides forensic medical exams and additional forensic services to a victim (provider) is entitled to reimbursement from the victim services division of the Indiana criminal justice institute (division) if the provider initiates a claim for reimbursement through the sexual assault web based claims reimbursement and tracking system. Provides that personal information: (1) concerning a sexual assault victim; and (2) entered into the division's web based claims reimbursement and sexual assault examination kit tracking system; is confidential in certain instances. Provides that notification of a forensic sample's destruction may be provided by the division through the sexual assault web based claims reimbursement and tracking system. Requires law enforcement agencies and prosecuting attorneys to cooperate with the division by providing storage updates to the division via the sexual assault web based claims reimbursement and tracking system. Allows a victim to register for notifications concerning a sexual assault examination kit through the sexual assault web based claims reimbursement and tracking system. Defines certain terms. Makes conforming amendments. Makes technical corrections.
Disabled Hoosier veteran license plate. Requires the bureau of motor vehicles (bureau) to redesign the disabled Hoosier veteran license plate. Specifies that a disabled Hoosier veteran license plate must consist of the following elements: (1) The display of an emblem denoting the branch of service in which the veteran served. (2) A depiction of a wheelchair to indicate the disabled status of the veteran. (3) The words "Disabled Hoosier Veteran" at the bottom of the license plate. (4) Identification numerals with consecutive numbers or letters, or both, to properly identify the vehicle. (5) Any other information the bureau considers necessary. Makes conforming technical amendments.
Disabled veterans parking placards. Requires the bureau of motor vehicles to design a parking placard that designates that the placard has been issued to a person who has been issued or is otherwise eligible to receive a disabled Hoosier veteran plate. Provides that the placard does not have an expiration date. Provides that a person who is qualified to receive a disabled Hoosier veteran plate and has been issued a permanent parking placard may not be charged a fee for parking in a metered space or assessed a penalty for parking in a metered space for longer than the time permitted.
Department of transportation matters. Removes a provision requiring each contract for highway work to be acknowledged before an officer authorized to administer oaths. Provides that a certificate of qualification issued by the department of transportation (department) is valid for a period of 24 months. Allows the department to adopt rules concerning eligibility and qualification requirements for bidders of contracts. Exempts the department from certain real property recording requirements. Makes conforming amendments.
Coroner access to emergency contact data base. Provides coroners with access to the emergency contact data base.
Motor vehicle matters. Provides that the bureau of motor vehicles (BMV) may develop a system to issue mobile credentials. Provides that the BMV may issue, upon request of an applicant, a mobile credential when the applicant satisfies the requirements for application for an identification card or various licenses and permits. Provides the BMV with rulemaking authority to implement the mobile credential system. Defines mobile credential. Makes conforming changes. Provides that an owner or last titled owner of a motor vehicle commits a Class C infraction when the owner or last titled owner of the motor vehicle abandons the vehicle. Provides that a unit or holder of a mechanic's lien including a towing service, city, town, or county shall forward a copy of the abandoned vehicle report including a copy of the complaint and summons to the public agency who placed the abandoned vehicle tag on the vehicle. Provides that the public agency shall send the complaint and summons by first class mail to the owner of the vehicle. Provides for the form for a complaint and summons for the offense of abandoning a vehicle. Provides a procedure to change the gender that appears on a driver's license, permit, identification card, or photo exempt identification card.

Central Indiana public transportation projects. Repeals the prohibition that prevents certain counties from: (1) purchasing; (2) leasing; (3) acquiring; (4) constructing; or (5) operating a light rail project. Makes a conforming amendment.
Modified symbol of access. Requires that parking signs for accessible parking spaces for an individual with a physical disability must bear, instead of the international symbol of accessibility (also known as the international wheelchair symbol), the modified symbol of access when erected, replaced, or repaired after December 31, 2019. Requires that license plates and placards issued by the bureau of motor vehicles for display in or on a vehicle used to transport a person with a disability must bear, rather than the international symbol of accessibility, the modified symbol of access on all new license plates or duplicate or replacement plates after December 31, 2019.

Transportation grant administration. Provides that the department of transportation (department) must review applications submitted for the local road and bridge matching grant fund to determine whether the application is complete. Requires the department to provide reasons for denied applications or applications that do not receive the full amount of grant funding.
A SENATE RESOLUTION urging the legislative council to establish a study committee to study issues related to the regulation of railroad crossings.
Towing rights. Specifies requirements for a towing service or a person that owns private property that tows a vehicle from private property, including a notice of requirements that apply to the towing service's actions. Makes a violation by a towing service a Class B infraction.
Certificates of title. Provides that the bureau of motor vehicles may issue a salvage title to a vehicle designated as "JUNK" in certain situations.
Golf carts. Allows a golf cart to operate on certain state highways under certain conditions.
Consular identification. Requires a state agency, a political subdivision, or an employee of a state agency or political subdivision to accept a consular identification document submitted by an individual as valid identification of the individual in most situations. Provides that a consular identification document may not be accepted: (1) from an individual registering to vote or obtaining a driver's license; (2) when acceptance is not permitted under federal law; or (3) when acceptance would jeopardize funding from a particular source. Provides that information collected from or appearing on a consular identification document is subject to the same privacy protections and limitations on disclosure that apply to information collected from or appearing on a driver's license or an identification card. Provides that, unless otherwise provided by federal law, a consular identification document: (1) does not establish or indicate lawful United States immigration status; (2) may not be considered valid for that purpose; and (3) does not establish a foreign national's right to be in or to remain in the United States. Repeals statutes defining offenses related to consular identification.
Driving cards. Provides for the issuance of driving cards and driving card learner's permits (cards) to residents of Indiana who cannot provide proof of identity and lawful status in the United States. Provides that cards may not be used for federal identification or any federal purposes. Requires that an individual who holds a card and operates a motor vehicle must verify that financial responsibility on any motor vehicle that the holder operates is continuously maintained in the amounts required by law. Makes conforming amendments. Makes technical corrections.
Electric bicycles. Defines the term "electric bicycle" as a bicycle equipped with: (1) operable pedals; and (2) an electric motor with a power output not greater than 750 watts. Provides that an electric bicycle is not a motor vehicle. Provides that the operator of an electric bicycle is: (1) subject to all of the duties; and (2) entitled to all of the rights and privileges; of a bicycle operator. Provides that an electric bicycle shall be regulated as a bicycle. Provides certain exceptions. Exempts the operator of an electric bicycle from motor vehicle statutes concerning: (1) driver's licenses; and (2) financial responsibility. Exempts electric bicycles from motor vehicle statutes concerning: (1) certificates of title; (2) registration; and (3) off-road vehicles. Requires manufacturers and distributors of electric bicycles to affix and prominently display a label with the following information on each electric bicycle: (1) The class level of the electric bicycle. (2) The top assisted speed of the electric bicycle. (3) The total power output of the electric bicycle's electric motor. Requires all electric bicycles to comply with certain requirements adopted by the United States Consumer Product Safety Commission. Requires all electric bicycles to be equipped with an electric motor that disengages or ceases to function when the operator: (1) stops pedaling; or (2) applies brakes. Specifies where electric bicycles may be operated. Allows a local authority or state agency with jurisdiction over a trail, bicycle path, or multipurpose path to regulate the use of electric bicycles on a trail, bicycle path, or multipurpose path subject to the local authority's or state agency's jurisdiction. Prohibits a person under 15 years of age from operating certain electric bicycles. Allows a person under 15 years of age to ride as a passenger on certain electric bicycles. Requires a properly fitted and fastened helmet capable of meeting certain safety standards to be worn by certain individuals when operating or riding on certain electric bicycles. Defines certain terms. Makes conforming amendments.
Operation of safety rest areas. Requires the office of tourism development and the Indiana department of transportation (INDOT) to enter into a memorandum of understanding under which the office of tourism development will assume the responsibility of operating safety rest areas. Provides that the terms of a memorandum of understanding concerning the operation of safety rest areas must provide that INDOT retains ownership of real property acquired to construct safety rest areas.
Driver instruction regarding law enforcement procedures. Requires the bureau of motor vehicles to include in any driver's manual published by the bureau: (1) a description of law enforcement procedures during a traffic stop; and (2) actions a motorist should take during a traffic stop, including appropriate interactions with law enforcement officers. Requires the driver education advisory board to consult with the commissioner of the bureau of motor vehicles and the state police department regarding instruction on: (1) law enforcement procedures during traffic stops; and (2) actions a motorist should take during a traffic stop, including appropriate interactions with law enforcement officers.
Law enforcement officer training. Allows the law enforcement training board to establish minimum standards concerning firearms marksmanship and proficiency. Provides that firearms proficiency may not be taught or tested through the use of any target bearing a photorealistic depiction of a human being in any law enforcement: (1) basic training course; (2) inservice course; or (3) refresher course; used to train or accredit a law enforcement officer.
Grants from state disaster relief fund. Provides that the maximum amount that an individual may receive from the state disaster relief fund (fund) as compensation for damages to the individual's property is $10,000. (Current administrative rules provide that the maximum amount is $5,000.) Voids provisions in the Indiana Administrative Code that set forth a maximum compensation amount of $5,000. Directs the department of homeland security (department) to amend, before July 1, 2020, the administrative rule concerning the fund to reflect a maximum compensation amount of $10,000 for individuals. Makes an annual appropriation from the state general fund to the fund for the department's use in carrying out the purposes of the fund.
Peer to peer car rentals. Specifies that a car facilitation company is a company facilitating the noncommercial use of a privately owned passenger motor vehicle by a person other than the vehicle's registered owner. Provides that a car facilitation company is treated the same as a car rental company under the trade regulation statutes and for purposes of the state gross retail and use tax, the state auto rental excise tax, and the Marion County and Vanderburgh County car rental excise taxes. Specifies requirements related to a car facilitation transaction and vehicle safety recalls. Makes conforming amendments.
Motor vehicle safety. Requires that a license plate must be displayed in a horizontal and upright position that displays the registration expiration year in the upper right corner. Requires that a renewal sticker for a license plate must be securely affixed in the upper right corner of the license plate covering the previous registration expiration year. Provides that a trailer of less than 3,000 pounds gross weight is not required to be equipped with brakes. Specifies that head lamps on motor vehicles, motorcycles, and motor driven cycles may display only white or amber light. Requires that motor vehicles except for
Road and utility repair. Requires the department of transportation (department) to schedule an appeal of a local unit's denial of a petition to close a railroad crossing within 60 days after the denial of the petition. Defines "department action" as one or more of the following: (1) Detour creation or implementation. (2) Planned bridge repair. (3) Planned road repair. Requires the department to consider the following when determining when to let a contract involving certain construction, maintenance, and repair projects: (1) Impact on local commerce. (2) Impact on local residents. (3) Impact on local tourism. Requires the department to make
Dealer services division. Requires certain definitions to be used in the dealer services law. Includes: (1) flood damage affidavits; (2) title affidavits; (3) interim plates generated in error; and (4) copies of rebuilt vehicle disclosures; as records for purposes of the dealer services law. Requires a motor vehicle or watercraft dealer to identify in a title affidavit whether a lien exists on the motor vehicle or watercraft and the date any obligation must be satisfied. Provides that a dealer may provide an interim plate when the dealer: (1) sells or leases a motor vehicle; or (2) allows a purchaser to
Motor vehicle matters. Establishes the department of state revenue pilot program (pilot program). Specifies that the purpose of the pilot program is to assist the state, other states, and other government agencies with: (1) the administration and processing of commercial vehicle registrations as required under the International Registration Plan; (2) the licensing and reporting of fuel tax use for motor carriers under the International Fuel Tax Agreement; (3) audit and record keeping for the International Registration Plan and the International Fuel Tax Agreement; and (4) any other essential or necessary functions related to the motor carrier services. Establishes the pilot
Health matters. Provides that a law enforcement officer who is exposed to blood or body fluids may request to be included in the list of individuals who are provided with notification concerning exposure to a dangerous communicable disease. Specifies that HEA 1017- 2018 concerning newborn screening takes effect on July 1, 2018, instead of on April 1, 2018.
Transport operator. Defines "disposable trailer". Requires the bureau of motor vehicles to issue a transport operator license plate to an operator of a tractor-mobile home rig or a special tractor-mobile home rig transporting a sectionalized building using a disposable trailer upon application for the license plates. Adds disposable trailers to a statutory list of vehicles that are not required to be registered. Makes conforming changes.
Automobile dealers. Defines "vehicle right of use subscription program". Prohibits vehicle right of use subscription programs. Provides that a dealer or manufacturer may not impose a surcharge on a dealer for the sole purpose of recovering costs related to the reimbursement of a dealer for parts or labor. Requires a manufacturer to: (1) provide a dealer with written notification of the grounds upon which a claim is being charged back as a result of an audit; (2) provide dealers with a reasonable appeals process concerning certain fees, payments, and reimbursements; and (3) allow a dealer to cure certain administrative errors

Autonomous vehicles. Provides that a political subdivision may not enact a measure, ordinance, policy, regulation, rule, or other restriction that prohibits the authorized use of: (1) an automated driving system; (2) an automated vehicle; or (3) an on demand automated vehicle network. Provides that a person in possession of a valid driver's license may operate an automated vehicle at a Level 1, 2 or 3 on a public highway. Requires any person or entity who operates an automated vehicle to maintain proof of financial responsibility with the bureau of motor vehicles (bureau). Requires automated vehicles to comply with all applicable
Vehicle weight limits. Excludes bulk milk from the definition of "overweight divisible load". Provides that the department of transportation (department) may issue an overweight permit for the transportation of bulk milk up to 100,000 pounds. Requires the department to issue an annual permit with a fee of $20 to an applicant for a bulk milk permit whose total equivalent single axle load calculation is equal to or less than 2.40 equivalent single axle load credit. Requires the department to issue a nondivisible overweight permit to an applicant for a bulk milk permit whose total equivalent single axle load calculation is
Specialized driving privileges. Provides that an individual's specialized driving privileges expire at the time the suspension of the individual's driving privileges is terminated if: (1) the underlying conviction, charge, adjudication, or determination that forms the basis of the suspension is reversed, vacated, or dismissed; or (2) the individual is acquitted of, found not liable for, or otherwise found not to have committed the underlying act or offense that forms the basis of the suspension. Requires the court to inform the bureau of motor vehicles of a termination of a suspension and expiration of specialized driving privileges.

Defines "transferring party" as a person that: (1) is listed on the certificate of title as an owner of the vehicle; or (2) is acting as an agent of the owner and holds power of attorney for the owner of the vehicle. Carbon monoxide emissions testing. Provides that a fire department established by a: (1) county; (2) city; (3) town; or (4) township; or a volunteer fire department may provide vehicular carbon monoxide testing (testing) to the owner of a motor vehicle. Requires testing to be offered to the owner of a motor vehicle without charge. Specifies the manner in which testing is to be conducted. Specifies certain paperwork and record keeping requirements. Provides that a test administrator's good faith effort to properly conduct a vehicular carbon monoxide test immunizes the test administrator from civil liability and all associated damages, including punitive
Central Indiana public transportation projects. Repeals the prohibition that prevents certain counties from: (1) purchasing; (2) leasing; (3) acquiring; (4) constructing; or (5) operating a light rail project.

Provides that health coverage for a surviving child continues: (1) until the child becomes 18 years of age; (2) until the child becomes 23 years of age, under certain circumstances; or (3) during the entire period

Operation of off-road vehicles. Exempts the following individuals from the requirement of wearing a helmet while operating or riding on an off-road vehicle if the off-road vehicle is equipped with a roll cage: (1) An individual at least eight years of age who operates or rides on the off-road vehicle while wearing a safety belt. (2) An individual less than eight years of age who rides on the off-road vehicle while restrained in a child restraint system in accordance with state law. Defines "roll cage".
Vehicle weight. Adds coal to the list of commodities hauled within the definition of "overweight divisible load". Specifies that a tractor-semitrailer hauling coal must have a gross vehicle weight of more than 80,000 pounds but not more than 120,000 pounds to meet the requirements of the definition.
Traffic stop safety education. Requires that an examination for a learner's permit or driver's license must include a test of the applicant's knowledge of the rights and responsibilities of a driver and passenger during a traffic stop by a law enforcement officer. Requires the driver education advisory board to consult with the commissioner of the bureau of motor vehicles and the state police department on the administration of a traffic stop safety education program. Requires the bureau of motor vehicles to coordinate with the state police department to provide a traffic stop safety education program.
Public use airports. Requires a person to apply for and receive a permit from the department of transportation (department) in order to construct on, alter, use, develop, or modify land located not more than two miles from a public use airport. Provides that the department may not grant the permit if the proposed construction, alteration, use, development, or modification (project) may contribute to, attract, or create an airport hazard that is detrimental to aviation safety within the airport operations area. Requires a permittee, when seeking a permit for the project from a local governmental agency, to provide to the local
Driving authority permits. Provides for the issuance of driving authority permits and driving authority learner's permits (permits) to residents of Indiana who cannot provide proof of identity and lawful status in the United States. Provides that permits may not be used for federal identification or any federal purposes. Requires that an individual who holds a permit and operates a motor vehicle must verify that financial responsibility on any motor vehicle that the holder operates is continuously maintained in the amounts required by law. Makes conforming amendments. Makes a technical correction.
Prohibition on tollways around Indianapolis. Prohibits the imposition of tolls on any interstate highway within 15 miles of the center of Indianapolis (Monument Circle).
Driving cards. Provides for the issuance of driving cards and driving card learner's permits (cards) to residents of Indiana who cannot provide proof of identity and lawful status in the United States. Provides that cards may not be used for federal identification or any federal purposes. Requires that an individual who holds a card and operates a motor vehicle must verify that financial responsibility on any motor vehicle that the holder operates is continuously maintained in the amounts required by law. Makes conforming amendments. Makes technical corrections.
Grants from state disaster relief fund. Provides that the maximum amount that an individual may receive from the state disaster relief fund (fund) as compensation for damages to the individual's property is $10,000. (Current administrative rules provide that the maximum amount is $5,000.) Voids provisions in the Indiana Administrative Code that set forth a maximum compensation amount of $5,000. Directs the department of homeland security (department) to amend, before July 1, 2019, the administrative rule concerning the fund to reflect a maximum compensation amount of $10,000 for individuals. Makes an annual appropriation from the state general fund to the fund
Various motor vehicle law amendments. Renames the county motor vehicle excise surtax to be the county vehicle excise tax. Renames the municipal motor vehicle license excise surtax to be the municipal vehicle excise tax. Renames the motor vehicle license excise tax to be the vehicle excise tax. Makes other revisions in the following statutes: (1) The vehicle excise tax. (2) The excise tax on recreational vehicles and truck campers. (3) The commercial vehicle excise tax. (4) The boat excise tax. Makes clarifying amendments in Title 9. Provides that an autocycle manufactured before July 1, 2015, is not required to be
Title 9 technical corrections. Makes technical and other corrections to statutes amended or affected by HEA 1087-2016.
Regional infrastructure improvement projects. Provides that the Indiana finance authority (IFA), rather than the budget agency, administers the local infrastructure revolving loan funds (loan funds). Expands the types of entities that may participate in the loan funds. Authorizes the IFA to issue its bonds to carry out the loan funds. Expands the types of infrastructure that are eligible for the loan funds to include bridges or other public ways. Provides that a regional development authority (RDA) may apply for a "FASTLANE" grant from the Federal Highway Administration (or a grant from any other federal program) for highway funding. Authorizes an
Department of transportation property matters. Provides that the commissioner of the department may transfer certain real property owned by the department to a nonprofit land management organization without a prior appraisal if: (1) the real property is owned by the department in fee simple; and (2) the real property is nonmarketable due to environmental mitigation requirements imposed by federal or state regulations. Requires the department to establish rules for approving installation of traffic control signals. Defines certain terms. Raises the dollar amounts for when certain financial statements must be prepared and attested as audited, reviewed, or certified as correct in
Transportation of agricultural commodities. Provides that definition of "farm product" does not include: (1) lumber; (2) logs; (3) wood chips; (4) bark; or (5) sawdust. Modifies the definition of "overweight divisible load". Provides that an owner of a "carrier, shipper, or other party" may not cause or knowingly permit a vehicle to: (1) exceed certain size or weight restrictions; and (2) be operated upon a highway. Specifies that certain infractions concerning vehicle size and weight are Class C infractions. Prohibits the bureau of motor vehicles from assessing points under the point system for violations of commercial size and weight limitations
Emergency contact data base. Requires the bureau of motor vehicles (bureau) to create, maintain, and operate the Indiana emergency contact data base (data base). Requires a law enforcement officer to: (1) access the data base; and (2) attempt to contact emergency contact persons; within a reasonable amount of time after learning of death or serious bodily injury to an individual holding certain credentials issued by the bureau. Allows each credential holder to have not more than two emergency contact persons entered in the data base. Provides that information contained in the data base is confidential and exempt from disclosure or
Railroads and eminent domain. Defines "corporation", "rail carrier", and "railroad". Specifies that eminent domain may be exercised by a rail carrier incorporated in Indiana or authorized to do business in Indiana, and prescribes the manner in which a railroad (including a rail carrier) may incorporate. Requires a rail carrier to demonstrate that property will be used for a public use before the carrier may use eminent domain to take the property. Eliminates the provisions in the law under which a defendant in an eminent domain proceeding who appeals an interlocutory order overruling the defendant's objections to the proceeding is required
Critical incident stress management services. Provides confidentiality protection to communications that emergency responders make to critical incident stress management personnel or records that are generated by critical incident stress management personnel after providing critical incident stress management services to emergency responders following a critical incident. Provides that critical incident stress management personnel are immune from liability for any acts, errors, or omissions committed in providing critical incident stress management services to emergency responders, unless the act, error, or omission constitutes wanton, willful, or intentional misconduct.
Driver safety program. Requires that an individual less than 21 years of age must complete a driver safety program approved by the bureau of motor vehicles if the individual has at least twice been the operator of a motor vehicle involved in an incident for which points may be assessed by the bureau. Provides that the duration of certain court ordered specialized driving privileges may not exceed 2.5 years in length. Provides that the compliance response period for proof of financial responsibility is 40 days before July 1, 2017 and 90 days after June 30, 2017.
Firearms matters. Establishes a procedure for the return or disposal of certain firearms in the custody of a law enforcement agency.
Driver's licenses for foster children. Allows an individual who is at least 16 years of age but less than 18 years of age and is under the care and supervision of the department of child services (department) to: (1) obtain an identification card, learner's permit, or operator's license without paying a fee; (2) contract for a policy of motor vehicle insurance; and (3) complete driving practice with individuals approved by the department.
Crisis intervention teams. Provides that in conjunction with the Indiana commission (commission) to combat drug abuse and the division of mental health and addiction, the law enforcement training board may establish the technical assistance center. Provides that the commission may make grants to the law enforcement training board to carry out the purposes of the technical assistance center. Transfers the administration of the technical assistance center for crisis intervention teams from the Indiana criminal justice institute to the Indiana law enforcement training board. Makes a technical correction.
Hospital police departments. Defines "health system". Allows for health systems to establish police departments. Expands the area in which hospital police officers may exercise police powers. Establishes the Indiana health care facilities task force (task force). Requires the task force to: (1) study and review hospital and health facility licensure; (2) study, review, and update the American Institute of Architects guidelines for hospitals and health care facilities; (3) study, review, and update National Fire Protection Association standards for hospitals and health care facilities; and (4) submit an electronic report to the governor and the legislative council setting forth the task
Air ambulance services. Adds a representative of an entity that provides air ambulance services to the composition of the Indiana emergency medical services commission (commission). Requires the commission with the assistance of the state department of health to develop and recommend statewide standards for activation and use of air medical services for transport of patients from the emergency scene to a trauma center. Requires that the standards must be updated at least every three years. Provides a public safety officer special death benefit to an emergency medical services provider who, after June 30, 2017, dies as a direct result of
Bicycle trails. Establishes the Indiana bicycle trails task force (task force) to: (1) develop actionable concepts to connect existing bicycle trails throughout Indiana; (2) estimate the cost of each concept; (3) present at least six innovative ways to fund the connections to existing bicycle trails; (4) prepare a timeline that shows the phases of completion to connect existing bicycle trails throughout Indiana for each funding method; and (5) recommend changes to Indiana law to increase bicycle safety on trails and roadways. Requires the task force to submit a report to the legislative council and governor not later than July 1,
Completion of training by volunteer firefighters. Requires a volunteer firefighter to successfully complete certain minimum basic training requirements before performing the emergency response duties of a volunteer firefighter. Grants police powers to a fire investigator who has successfully completed law enforcement training and meets other specified conditions.
Urging the Indiana Department of Transportation to rename that part of U.S. Highway 231 from Interstate Highway 69 to the city of Bloomfield the "Donald W. Dean Memorial Highway".
Urging the Indiana Department of Transportation to rename that section of U.S. Highway 27, both north and south, through Lynn, Indiana, as the "Captain Charles Edwin Engle Memorial Mile."
Elimination of state agency public safety committee. Abolishes the state agency public safety committee.
Civic event motor vehicles and license plates. Allows a person to display a civic event license plate on the civic event motor vehicle after the term of the civic event, if certain conditions are met.
Specialty constructed vehicles. Provides that a vehicle: (1) built to resemble and be a reproduction of another vehicle that was manufactured at least 25 years ago; and (2) assembled using all new or used parts; must be titled as a "specialty constructed vehicle". Urges the legislative council to assign to the appropriate study committee the task of conducting a study that compares Indiana's titling process for home built, "kit", replica, or specialty constructed cars with the titling process used by other states to title such vehicles.
Nondomiciled commercial driver's licenses. Requires the bureau of motor vehicles to issue nondomiciled commercial driver's licenses in accordance with federal regulations after December 31, 2017. Requires an individual who applies for a nondomiciled commercial drivers license to submit a proper application under IC~9-24.
Study of law enforcement training matters. Urges the legislative council to assign to the appropriate committee a study of: (1) possible sources of funding for new and existing law enforcement academies; (2) possible sources of funding for law enforcement officer training; (3) alternative sources of funding for law enforcement academies and officer training; (4) the sustainability of existing revenue streams responsible for funding law enforcement academies and officer training; (5) possible locations for new or relocated law enforcement academies; (6) the repurposing of existing facilities for use as law enforcement academies; (7) the leasing of existing facilities for use as
A CONCURRENT RESOLUTION urging the Indiana Department of Transportation to rename the bridge over Interstate 65 at State Road 38 as the "Mark S. Davis Memorial Bridge".
A CONCURRENT RESOLUTION urging the Indiana department of transportation to rename the Washington Street Bridge on U.S. 24 in Monticello as the "Chief Master Sergeant Dean A. DuVall Bridge".
Public safety matters. Adds a new national firefighting training standard to current standards eligible for emergency rulemaking. Exempts government facilities from being assessed emergency and hazardous chemical inventory form fees.
Right-of-way in a roundabout. Requires a driver to yield the right-of-way to a driver of a vehicle having a total length of at least 40 feet or a total width of at least 10 feet when driving through a roundabout. Requires that, when two truck drivers approach or drive through a roundabout at the same time, the driver on the right yields the right-of-way to the driver on the left.
Law enforcement training. Requires the following to complete a refresher course if inactive for a specified time: (1) Reserve police officers. (2) Law enforcement officers who paid their own tuition for law enforcement training. (3) Board certified law enforcement training instructors. Eliminates a provision regarding refresher courses for law enforcement officers in policy making positions. Allows the law enforcement training board to make certain modifications to in-service training without adopting administrative rules.
Transfer of ownership of motor vehicles. Provides that a person that transfers ownership of a vehicle may deliver to the bureau of motor vehicles (bureau): (1) the certificate of registration of the vehicle; and (2) proof of the transfer of ownership of the vehicle. Requires the bureau, upon receipt of the certificate of registration and proof of transfer of ownership of the vehicle, to indicate the transfer of ownership in the records of the bureau.
Enforcement of vehicle weight restrictions. Prohibits the bureau of motor vehicles from assessing points under the point system for violations after December 31, 2015, of commercial weight limitations. Provides that points assessed after December 31, 2015, for such violations are null and void.
Transportation corridor planning. Repeals on July 1, 2017, the statute concerning transportation corridor planning. Provides that the repeal of the statute does not affect: (1) rights or liabilities accrued; (2) proceedings begun; or (3) project agreements or other contracts executed; under the statute before its repeal. Specifies that any funds: (1) remaining on July 1, 2017, in the transportation corridor fund; and (2) not committed, dedicated, or appropriated for, or otherwise needed to fulfill an obligation arising from, any project agreement or other contract executed under the statute before its repeal; revert to the state general fund. Moves to the
Compliance and enforcement. Makes conforming amendments to align certain motor vehicle statutes in the Indiana Code with requirements in the federal Fixing America's Surface Transportation (FAST) Act. Increases the hours of community service required for a person who has one or more previous convictions of operating while intoxicated.
Vehicle operation. Provides that a vehicle may not be driven or moved on a highway unless the vehicle is: (1) constructed; (2) covered; or (3) loaded; in a manner that prevents any of the vehicle's refuse or load, other than water, from dripping, sifting, leaking, dropping, blowing, spilling, or otherwise escaping from the vehicle. Requires areas of a vehicle containing aggregate material to be free from holes, cracks, or openings through which any of the vehicle's refuse or load may escape. Specifies that restrictions regarding a vehicle's aggregate material or load apply regardless of the degree to which the vehicle
Driving authority permits. Provides for the issuance of driving authority permits, probationary driving authority permits, and learner's driving authority permits (permits) to residents of Indiana who cannot provide proof of identity and lawful status in the United States. Provides that permits may not be used for federal identification or any federal purposes. Requires that an individual who holds a permit and operates a motor vehicle must verify that financial responsibility on any motor vehicle that the holder operates is continuously maintained in the amounts required by law. Makes conforming amendments.
Matching grant fund for local police departments. Establishes the law enforcement emergency response equipment matching grant fund to be administered by the department of homeland security. Allows local law enforcement agencies to apply for matching grants to purchase equipment needed for emergency response situations.
Adoption of National Electric Code. Requires the fire prevention and building safety commission to adopt by rules the most recent edition, including addenda, of the NFPA 70 (National Electric Code) and to adopt any subsequent edition of the NFPA 70, including addenda, within 18 months after the effective date of the subsequent edition.
Lap and shoulder safety belts on school buses. Provides that a school bus or special purpose bus that is placed into operation after June 30, 2018, and that is used to transport elementary school or high school students must be equipped with a 3-point lap and shoulder safety belt (safety belt) at each seating location. Requires the state school bus committee to adopt rules for the design, installation, and use of safety belt systems that must be installed in school buses and special purpose buses. Provides for an exception to the laws concerning other types of passenger restraint systems. Requires
Symbol to signify accessible parking. Requires that parking signs for accessible parking spaces for an individual with a physical disability must bear, instead of the international symbol of accessibility (also known as the international wheelchair symbol), the modified symbol of access. Requires that license plates and placards issued by the bureau of motor vehicles for display in or on a vehicle used to transport a person with a disability must bear, rather than the international symbol of accessibility, the modified symbol of access.
Electric power grid security. Requires the division of planning and assessment of the Indiana department of homeland security to: (1) develop an emergency response plan for an attack on or systematic failure of the electric power grid; and (2) develop standards for increasing the physical security of the electric power grid.
Emergency rules for outdoor event equipment. Expands the authority of the fire prevention and building safety commission to adopt temporary rules in the manner of emergency rules to govern outdoor event equipment.
Seatbelts on school buses. Provides that, after June 30, 2017, if a school corporation or an accredited nonpublic school enters into a lease for, purchases, or otherwise acquires a school bus or special purpose bus that is used to transport elementary school or high school students, the school bus or special purpose bus must be equipped with a 3-point lap and shoulder safety belt (safety belt) at each seating location. Requires that, after June 30, 2027, a school bus or special purpose bus that a school corporation or an accredited nonpublic school uses to transport elementary school or high school
Indiana Commerce Connector. For purposes of the statute concerning tollways, allows the designation of the Indiana Commerce Connector as a tollway. For purposes of the statute governing public-private agreements concerning toll roads, allows a public-private agreement (without legislative authorization) that would allow an operator to impose tolls for the operation of motor vehicles. For purposes of the statute governing public-private agreements by the department of transportation (department): (1) authorizes a public-private agreement for the Indiana Commerce Connector; and (2) provides that if all or part of a project to be carried out by a public-private agreement will consist of a
School bus equipment. Provides that a school bus or special purpose bus that is purchased after January 1, 2018, and that is used to transport elementary school or high school students must be equipped with a 3-point lap and shoulder safety belt (safety belt) at each seating location. Requires the state school bus committee to adopt rules for the design, installation, and use of safety belt systems that must be installed in school buses and special purpose buses. Provides for an exception to the laws concerning other types of passenger restraint systems. Requires each occupant of a school bus or
Tax credit for bridge toll expenses. Provides an income tax credit to qualified businesses that pay tolls to cross certain Ohio River bridges. Provides that a qualified business is a business entity that: (1) is authorized to transact business in Indiana; (2) maintains its principal office, or a branch office, in Clark County or Floyd County; (3) incurs at least $500 of qualified toll expenses to cross certain Ohio River bridges during a taxable year; and (4) has a Riverlink commercial account. Provides that the amount of the tax credit may not exceed the lesser of: (1) the amount of
Interstate mutual aid agreements. Requires an interstate mutual aid agreement to provide immunity from liability for emergency responders from Indiana who travel out of state to provide mutual aid or engage in training and exercises under a mutual aid agreement.
Homeland security matters. Establishes the Indiana advisory security council to advise the governor concerning Indiana's homeland security policy and preparedness and to coordinate homeland security efforts among state agencies. Requires the executive director of the Indiana department of homeland security to prepare emergency response plans to address the following: (1) A failure of Indiana's electrical grid and related systems. (2) An earthquake in the New Madrid seismic zone or Wabash Valley seismic zone. Requires political subdivisions to comply with the National Incident Management System developed by the Federal Emergency Management Agency.
Tax deduction for Ohio River bridge tolls. Provides an income tax deduction to qualified individuals who pay tolls to cross certain Ohio River bridges. Provides that a qualified individual is an individual who: (1) resides in Clark County or Floyd County; (2) incurs at least $100 in nonreimbursed toll expenses to cross the Ohio River bridges in Clark County or Floyd County during a taxable year; and (3) has a Riverlink personal account. Provides that the amount of the tax deduction may not exceed the lesser of: (1) the amount of nonreimbursed tolls paid by the qualified individual during the
Attorney general. Includes in the definition of "law enforcement officer" the attorney general, a deputy attorney general, a special deputy attorney general, and an investigator for the attorney general for the purposes of certain sentence enhancements and statutes relating to the possession of a firearm. Requires the attorney general to annually issue a photographic identification card to certain employees identifying them as a law enforcement officer.
Income tax credit for toll road charges. Provides an income tax credit to individuals who pay tolls to drive on the Indiana toll road for a nonbusiness purpose. Provides that the amount of the tax credit may not exceed the lesser of $300 or the amount of tolls paid by an individual during the taxable year. Provides that the tax credit may not exceed an individual's adjusted gross income tax liability.
Specialized driving privileges. Provides that the duration of certain court ordered specialized driving privileges may not exceed 2.5 years in length.
Operation of dashboard cameras. Requires a state or local government law enforcement agency that installs audiovisual recording systems in the agency's patrol cars to adopt a policy meeting certain requirements regarding the use of the recording system.
Moving traffic violations. Provides that a person may not drive a vehicle while holding an animal.
Bureau of motor vehicles omnibus bill. Relocates and modifies the following after expiration or repeal: IC 9-14 (Bureau of Motor Vehicles). IC 9-15 (Bureau of Motor Vehicles Commission). IC 9-16 (License Branches). IC 9-18 (Registration). IC 9-24-6 (Commercial Driver's License). IC 9-29 (Fees) (other than IC 9-29-17 (Fees Under IC 9-32)). Establishes limits for convenience fees charged by full service and partial services providers. Changes distributions of various fees imposed by the bureau of motor vehicles. Replaces chauffeur's and public passenger chauffeur's licenses with for-hire endorsements. Establishes refund procedures for fees imposed by the bureau of motor vehicles. Amends provisions
Interim study committees. Urges the legislative council to assign to the appropriate interim study committee the topic of transportation advisory boards.
Local airport authorities. Provides that a member (member) of a governing body of an airport authority or a department of aviation (governing body) may participate in a board meeting by electronic communication. Defines "commercial aeronautics" for purposes of serving on a governing body. Provides that a member may not have a pecuniary (rather than a personal) interest in a contract with or claim against the governing body.
Employment of veterans as public safety officers; 1977 fund retirement age. Waives the maximum hiring age restrictions that apply to the appointment and hiring of police officers and firefighters for an individual who is a veteran of the armed forces and who meets certain requirements. Provides that an individual who is appointed as a police officer or a firefighter as the result of a waiver is eligible to become a member of the 1977 police officers' and firefighters' pension and disability fund (1977 fund). Requires a member of the 1977 fund to retire at 70 years of age.
Blue LED lights on volunteer firefighter vehicles. Authorizes a blue light on a vehicle privately owned by a volunteer firefighter to be a blue light emitting diode (LED).
Geolocation information and unmanned aerial vehicles. Provides that, upon the request of a law enforcement agency, a provider of electronic communications services used by an electronic device is required to provide geolocation information concerning the electronic device to the law enforcement agency: (1) to allow the law enforcement agency to respond to a call for emergency services; or (2) in an emergency situation that involves the risk of death or serious bodily injury to an individual. Specifies that a law enforcement agency may make a request for geolocation information without first obtaining a search warrant or another judicial order that
Local emergency planning committees. Provides that membership on the emergency response commission (commission) is not a lucrative office for purposes of the constitutional prohibition against holding more than one lucrative office at the same time. Specifies that the commission appoints the members of the local emergency planning committee of each emergency planning district. Provides that the commission may decide how many members a local emergency planning committee is to have, and that a local emergency planning committee's members must include representatives of five particular categories. Provides that membership on a local emergency planning committee is not a lucrative office. Allows
School emergency response systems. Requires the department of homeland security (department) to establish minimum standards and approve best practices not later than July 1, 2017, for a school emergency response system. Defines the term "emergency response system". Defines the term "school property". Requires the department to establish emergency response system guidelines with input from the division of school building safety.
Road funding and regional cities program. Provides for the transfer of the state's excess reserves to the local road and bridge matching grant fund and the state highway fund. Provides that use tax collected on sales of gasoline is distributed differently than ordinary sales and use tax collections. Provides for income tax rate reductions for non-corporate taxpayers that are phased in from 2019 to 2025. Provides that a county may impose the county motor vehicle license excise surtax and the county wheel tax at higher rates if the county uses a transportation asset management plan approved by the department. Authorizes
Counterterrorism. Defines "terrorist associated person" as a person who: (1) is named on the FBI's terrorist watch list; or (2) is an illegal alien from a state that is occupied by certain terrorist organizations. Provides that a terrorist associated person who: (1) communicates by cellular telephone or another cellular device; or (2) publishes a communication on a social media web site; commits unlawful communication by a terrorist associated person, a Level 4 felony. Requires a law enforcement agency with probable cause to believe that a terrorist associated person is committing unlawful communication by a terrorist associated person to notify the
Threat assessments and critical infrastructure. Requires the executive director of the department of homeland security (department) to: (1) examine vulnerabilities of and threats to critical infrastructure and other possible targets of criminal or terrorist activity; and (2) make legislative and administrative recommendations based on the department's analysis of the examination results to the legislative council and the governor. Requires the division of planning and assessment within the department to: (1) develop and maintain a clearinghouse that collects information from and distributes information to local law enforcement agencies; (2) develop and publish a state threat assessment system; and (3) develop and
Driver's licenses for veterans. Provides that an individual may request an indication of the individual's status as a surviving spouse of a veteran on the individual's driver's license or state identification card. (Current law provides only for an indication of veteran status.) Provides that driver's licenses and permits and state identifications for certain veterans and surviving spouses of veterans may be issued without charge.
Transportation planning. Requires the Indiana department of transportation to report to the general assembly on plans to establish, and funding mechanisms for, additional traffic lanes on part of Interstate Highway 65.
Vehicle clearance when overtaking a bicycle. Provides that it is a Class C infraction for the operator of a vehicle overtaking a bicycle to not: (1) allow at least three feet of clearance between the vehicle and the bicycle; and (2) wait to return to the original lane until the vehicle is safely clear of the bicycle. Revises the definition of "bicycle" for purposes of the motor vehicle code.
Pump disclosures by automotive fuel retailers. Requires a retailer that markets automotive fuel to the general public and that has at least one retail location in Indiana from which the retailer dispenses automotive fuel for sale to do the following: (1) Post the automotive fuel rating of all automotive fuels that the retailer sells by putting at least one label on the face of each dispenser through which the retailer sells such fuels. (2) Comply with the federal Petroleum Marketing Practices Act and regulations adopted under that act. (3) Comply with the state department of health's motor fuels inspection program.
Lap and shoulder safety belts on school buses. Provides that a school bus or special purpose bus placed into operation after June 30, 2017, that is used to transport elementary school or high school students must be equipped with a 3-point lap and shoulder safety belt (safety belt) at each seating location. Requires the state school bus committee to adopt rules for the design, installation, and use of safety belt systems that must be installed in school buses and special purpose buses. Provides for an exception to the laws concerning other types of passenger restraint systems. Requires each occupant of
Unmanned aerial vehicles. Allows the use of an unmanned aerial vehicle by a law enforcement officer or governmental entity without obtaining a search warrant if the law enforcement officer determines that the use of the unmanned aerial vehicle is required to obtain aerial photographs or video images of a motor vehicle accident site on a public street or public highway.
Law enforcement academies. Imposes a $1 fee on each bureau of motor vehicles transaction on which a fee already is imposed. Deposits the fees in the statewide law enforcement training fund to provide additional funding to law enforcement academies and training centers that: (1) are certified by the law enforcement training board; and (2) provide basic training to law enforcement officers. Makes a continuous appropriation.
Fire prevention and building safety commission. Requires the fire prevention and building safety commission to adopt by rules the most recent edition, including addenda, of the NFPA 70 (National Electric Code) and to adopt any subsequent edition of the NFPA 70, including addenda, within 18 months after the effective date of the subsequent edition.
Operation of dashboard cameras. Requires a state or local government law enforcement agency that installs audiovisual recording systems in the agency's patrol cars to adopt a policy regarding the use of the recording system. Provides that the policy must: (1) require all traffic stops to be recorded; (2) establish a procedure to follow if the recording system malfunctions; and (3) require a law enforcement officer to document the reason why a traffic stop was not recorded or was not recorded in its entirety.
Driving authority permits and learner's permits. Provides for the issuance of driving authority permits, probationary driving authority permits, and driving authority learner's permits to residents of Indiana who cannot provide proof of identity and lawful status in the United States. Provides that these permits may not be used for: (1) federal identification; or (2) any federal purposes. Requires that an individual who holds such a permit and operates a motor vehicle must ensure that required financial responsibility on the motor vehicle is continuously maintained in the amounts required by law. Makes conforming amendments. Removes outdated language.
Motorcycle registration fee. Eliminates the portion of the motorcycle registration fee that is currently distributed to the spinal cord and brain injury fund.
Use of telecommunications devices while driving. Provides that a person who is at least 21 years of age who uses a telecommunications device to perform any function available on the telecommunications device other than to: (1) place or receive a telephone call; (2) use a geolocation information service; or (3) use an application software designed to locate retailers of gasoline or motor fuel; while operating a moving motor vehicle commits a Class C infraction. Revises the term "telecommunications device" for purposes related to motor vehicle operation. Defines "geolocation information service" for purposes related to motor vehicle operation. Repeals the term
Obstructions at railroad-highway grade crossings. Imposes a minimum judgment of $200 for blocking a railroad-highway grade crossing. Deposits funds collected as judgments in the industrial rail service fund. Urges the legislative council to assign to an interim study committee for the 2015 interim period the topic of blocked railroad grade crossings.
Various motor vehicle matters. Authorizes the use of mini-trucks on Indiana roads other than interstate highways. Requires a mini-truck that is operated on an Indiana road to be titled and registered. Defines "person", for purposes of titling a vehicle, to include sole proprietorships. Requires a dealer of mini-trucks to register as a dealer. Imposes an annual excise tax of $30 on a mini-truck. Removes the requirement that an application for the fleet registration program for common registration dates for fleet vehicles contain a certificate of title and registration for all fleet vehicles in the exact name of the fleet operator.
Identification cards without an image. Requires the bureau of motor vehicles to issue a photo exempt identification card (card) that does not bear the image of the holder. Requires that an application for a card, among other requirements, must contain a digital image of the applicant. Provides that an individual may not have a card and a driver's license or identification card at a time. Provides that a retailer that in good faith accepts a card as proof of identification for a retail transaction is immune from civil liability that may occur as a result of the acceptance. Sets a
Compression release engine brakes. Provides that it is a Class C infraction for a person to drive a motor vehicle equipped with compression release engine brakes unless the motor vehicle is equipped with a muffler in good working condition so that excessive noise is prevented, with certain exceptions.
Various motor vehicle matters. Amends various title, registration, and driver's license requirements and taxing of vehicles. Provides that a partial services provider may impose, collect, and retain a convenience fee, subject to the approval of the bureau of motor vehicles commission. Requires the bureau of motor vehicles (bureau) to have an annual internal audit. Revises requirements for requests by the bureau for evidence of financial responsibility following an accident or a judgment or conviction for a violation of a motor vehicle law. Establishes administrative review procedures for claims of material error by the bureau. Repeals various provisions concerning: (1) commercial
Supervision of probationary drivers. Amends existing supervised driving requirements to receive a learner's permit or an operator's license. Provides that an individual with a disability who satisfies certain requirements is eligible to receive an operator's license. Repeals a superseded provision concerning probationary operator's licenses. Provides that an operator's license issued to an individual who is less than 21 years of age is a probationary license. (Under current law, the age limit for a probationary license is 18 years of age.) Requires the bureau of motor vehicles to adopt rules to establish minimum hours of instruction for approved driver education courses.
Private toll facilities. Authorizes the operator of a private toll facility to enforce toll violations (violation) through an automated traffic law enforcement system. Provides that the bureau of motor vehicles (BMV) shall withhold the registration of a vehicle that was operated in the commission of a violation if the owner of the vehicle fails to pay applicable fines and charges and authorizes the BMV to impose a fee for reinstating the registration of a vehicle used in the commission of a violation. Provides that the operator of a private toll facility is not required to pay fees for certain BMV
Crisis intervention teams. Requires the law enforcement training academy to include an overview of crisis intervention team (CIT) training model in initial training. Establishes the Indiana technical assistance center for crisis intervention teams to: (1) identify grants and other funds that may be used to fund CIT programs; (2) create and support a statewide CIT advisory committee; and (3) provide training, information, and technical assistance.
Statutory authorization to construct interstates. Removes requirement that the general assembly enact a statute authorizing the construction of I-69 in Perry Township (Marion County) before I-69 may be constructed in Perry Township.
Reserve officer training. Requires police reserve officers to complete mandatory inservice training: (1) in interacting with persons with mental illness, addictive disorders, mental retardation, autism, developmental disabilities, and Alzheimer's disease or related senile dementia; and (2) concerning human and sexual trafficking and high risk missing persons. Changes the term "mental retardation" to "intellectual disability".
Fire prevention and building safety. Changes the definition of "building law" to include a law governing sanitary conditions and sanitary facilities in elementary and secondary school buildings and on the school grounds. Allows the fire prevention and building safety commission to adopt temporary rules in a manner provided for the adoption of emergency rules to administer the regulation of sanitary conditions and sanitary facilities in elementary and secondary school buildings and on the school grounds. Allows the division of fire and building safety to designate a qualified third party inspector or inspection agency to act as the division's agent for
Fire and emergency response issues. Creates the intrastate mutual aid compact to complement existing mutual aid agreements. Allows the Indiana department of homeland security (IDHS) to deploy a national urban search and rescue response system task force as a state resource during Indiana emergencies and disasters, in conformance with federal requirements, through an agreement with a political subdivision that is a sponsoring agency of a task force. Repeals the interstate emergency management and disaster compact. Repeals the local emergency planning and right to know fund administered by the department of state revenue. Moves the statute concerning the local emergency planning
Autocycles and motorcycles. Defines autocycle for purposes of the motor vehicle code; provides that an autocycle is a motorcycle. Removes the requirement that the handlebars of a motorcycle or a motor driven cycle rise not higher than the shoulders of the driver when the driver is seated. Provides that the operator of or a passenger on an autocycle who is less than 18 years of age is not required to wear a helmet or protective face equipment. Regulates the operation of autocycles.
Military designation on driver's licenses and ID cards. Provides that an individual may request an indication of the individual's veteran status or active military or naval service status on the individual's driver's license or state identification card. (Current law provides only for an indication of veteran status.)
Chauffeur's license exemption. Authorizes an individual to transport: (1) a recreational vehicle; or (2) a towing vehicle and recreational vehicle; without a chauffeur's license in certain circumstances.
Abandoned mobile homes. Makes changes to the procedure in current law for the sale or salvage of an abandoned mobile home located on private property, other than mobile homes located in a mobile home community. Provides, except in the case of an abandoned mobile home offered for sale at auction, that the bureau of motor vehicles may not transfer the title to a mobile home or change the names on the title to a mobile home unless the owner holds a valid permit issued by the county treasurer. Provides that a permit to move, or transfer title to, a mobile
Northwest Indiana Law Enforcement Academy. Designates the Northwest Indiana Law Enforcement Academy as a criminal justice agency, and specifies that it is a board certified training center. Defines the powers and duties of its board of directors.
EMS provider death benefit. Provides a public safety officer special death benefit to an emergency medical services provider who, after June 30, 2015, dies as a direct result of personal injury or illness resulting from the provider's performance of duties under a contract entered into by the provider's employer to provide emergency medical services for a political subdivision if the provider's employer purchases coverage if the employer purchases coverage for all eligible emergency medical services providers of the employer. Provides that the cost of the coverage is $100 per year and that an employer may purchase the coverage by making
Fire training academy. Increases the board of firefighting personnel standards and education from 11 to 13 members. Allows the division of fire and building safety (division) of the Indiana department of homeland security (IDHS) to establish a fire and public safety academy training system to create and conduct programs to train public safety personnel. Allows the division to develop the programs in cooperation with other agencies, organizations, or educational institutions.
Speed limits in school zones. Provides that a city, town, or county may establish a speed limit of not less than 20 miles per hour on a street or highway upon which a school is located if the street or highway is under the jurisdiction of the city, town, or county. (Current law provides that the speed limit may not be less than 30 miles per hour outside an urban district.) Removes outdated language.
License plate life cycle. Provides that the cycle for issuance and replacement of certain license plates is not less than five years and not more than 10 years. (Current law requires a five year cycle for the license plates.) Makes a technical correction.
Motor vehicle matters. Defines: (1) "commercial motor vehicle", "gross combination weight rating", "gross combination weight", and "gross vehicle weight rating" for purposes of commercial motor vehicles to comply with federal standards; and (2) "gross vehicle weight" for purposes of commercial motor vehicles. Provides for an exception relating to overweight vehicles for certain vehicles transporting logs, wood chips, bark, and sawdust. Amends the definition of "farm tractor" to include farm tractors in the definition of "implement of agriculture". Excludes wagons, trailers, and other vehicles pulled by a farm tractor from the definition of "farm tractor". Makes technical corrections.
BMV and driver license compact. Provides that the bureau of motor vehicles may issue a person a driver's license if a party state to the driver license compact reports that the driver's license of the person is suspended and the bureau determines that the: (1) party state's report is erroneous; and (2) person's driver's license is not suspended by the party state or the suspension is terminated; under certain circumstances.
Fleet vehicle registration. Establishes the fleet registration program (program) for Indiana residents who own or lease at least 1,000 passenger motor vehicles or trucks with a declared gross weight of not more than 11,000 pounds. Provides that the bureau of motor vehicles shall administer the program.
South Shore line extension. Creates a program to provide state matching grants to the northwest Indiana regional development authority (RDA) for projects extending the Chicago, South Shore, and South Bend Railway (Railway). Requires the RDA to make certain commitments in order to receive a grant. Requires a return on investment analysis. Requires review of grant applications by the budget committee and approval by the budget agency. Establishes the South Shore line transit oriented development fund (fund). Provides that the RDA administers the fund. Provides that a political subdivision that contributes county economic development income tax revenue received by the political
Disclosures of security breaches. Makes the following changes to the statute concerning the breach of the security of data that includes the sensitive personal information of Indiana residents and that is collected and maintained by a person other than a state agency or the judicial or legislative department of state government: (1) Specifies that the statute is not limited to breaches of computerized data. (2) Repeals the definition of a term ("doing business in Indiana") that is not used in the statute. (3) Replaces the term "data base owner" with "data owner". (4) Defines the term "data collector" as a
Safe driving practices near stationary solid waste haulers. Defines solid waste hauler as a vehicle in which solid waste or recyclable materials are transported to a transfer station or final disposal facility. Provides that it is a Class A infraction for a person to fail to make a lane change or slow the person's vehicle when approaching a stationary solid waste hauler that is giving a signal by displaying alternately flashing amber lights. Provides that the failure to make a lane change or slow the vehicle results in an additional suspension of driving privileges when the failure results in damage
School emergency response systems. Urges the legislative council to assign to the appropriate interim study committee the topic of school emergency response systems for study during the 2015 interim.
Autocycles. Defines "autocycle" for purposes of motor vehicle law, and provides that an autocycle is a motorcycle. Makes conforming changes.
School bus stop arm violations. Provides that a law enforcement officer may arrest a person when the officer has probable cause to believe that the person has committed a misdemeanor by recklessly passing a school bus when the arm signal device of the bus is in the extended position. (Current law requires the officer to have probable cause to believe that the person is committing or attempting to commit the misdemeanor in the officer's presence.)
Transportation corridor development. Urges the legislative council to assign to the appropriate interim study committee the topic of transportation corridor development.
Transportation network companies. Requires a transportation network company (TNC) to have a permit issued by the Indiana department of transportation to provide TNC services in Indiana. Establishes requirements that a TNC must satisfy in order to be issued a permit. Provides that a person that violates TNC requirements commits a Class A infraction. Provides that a person that violates TNC requirements related to accessibility is subject to an additional penalty of up to $10,000. Establishes the accessible transportation fund to provide grants to TNCs that provide accessible services. Deposits the additional penalties in the fund.
First responder tactical training. Requires the department of homeland security (department) to develop core curriculum requirements and standards for tactical emergency casualty care training programs (TECC programs) for: full-time firefighters, law enforcement officers, emergency medical technicians, advanced emergency medical technicians, and paramedics (first responders). Requires first responders to successfully complete an eight hour basic level TECC program conducted: (1) as part of the first responder's basic training, if basic training is completed after December 31, 2017; or (2) before July 1, 2020, if the officer completes basic training before January 1, 2018. Allows the department to accredit the TECC programs
Civic event license plates and vehicles. Authorizes certain vehicles to be registered as civic event motor vehicles and to display a civic event license plate after the term of the civic event under certain circumstances.
Eagle Scout trust license plate. Establishes the Eagle Scout trust license plate and the Eagle Scout trust fund. Specifies that $25 from the proceeds of the sale of an Eagle Scout trust license plate shall be distributed to the National Eagle Scout Association, Boy Scouts of America.
Advanced technology vehicles. Imposes an annual fee on advanced technology vehicles. Deposits the fees in the motor vehicle highway account.
Automated license plate readers. Prohibits a law enforcement agency from retaining license plate data captured by an automated license plate reader unless: (1) a comparison of the captured plate data with a data base shows that the data is relevant to an ongoing criminal investigation, the location of a missing person or a fugitive from justice, or the commission of a crime; (2) the person in whose name the license plate was issued requests retention of the data; or (3) the data was obtained under a warrant.
School buses. Provides that when a school bus is operated on a highway, the driver shall load and unload a student as close as practical to the right-hand curb or edge of the roadway. Makes changes to prerequisites for bidders to receive school transportation contracts. Makes changes to the provision regarding when school bus drivers must obtain a physical examination. Adds a provision indicating what type of vehicle must be used to transport foster care students to the students' school of origin. Repeals a provision concerning inspection requirements for special purpose school buses.
Fire and building safety. Provides that for purposes of the building code, a Class 2 structure townhouse may be separated from an adjoining unit by a one hour fire-resistance rated wall combined with a National Fire Protection Association 13D compliant fire sprinkler system.
Advanced technology vehicle fee. Imposes an annual fee on advanced technology vehicles. Deposits the fees in the motor vehicle highway account.
Lost personal property submitted to police. Establishes a method for an individual who comes into possession of tangible personal property, except firearms, or cash that the individual: (1) does not own; and (2) submits to a law enforcement agency; to become the rightful owner of the tangible personal property or cash. Prohibits a law enforcement agency from turning over possession of tangible personal property or cash submitted to the law enforcement agency to any person if the tangible personal property or cash is: (1) needed as evidence in an ongoing criminal investigation; (2) dangerous; or (3) unusable.
Motorcycle equipment. Provides that a motorcycle may be equipped with a steering wheel. (Current law provides that a motorcycle may be equipped only with handlebars for purposes of steering and control.) Makes a corresponding change.
Driving authority permits and learner's permits. Provides for the issuance of driving authority permits, probationary driving authority permits, and driving authority learner's permits to residents of Indiana who cannot provide proof of identity and lawful status in the United States. Provides that these permits may not be used for federal identification or for any federal purposes. Requires that an individual who holds such a permit and operates a motor vehicle must ensure that required financial responsibility on the motor vehicle is continuously maintained in the amounts required by law. Makes conforming amendments. Removes outdated language.
Examination for driver's licenses. Requires the bureau of motor vehicles to conduct in certain foreign languages the testing and demonstration of ability to operate a motor vehicle.
Vehicle clearance when overtaking a bicycle. Provides that it is a Class C infraction for the operator of a vehicle overtaking a bicycle to not: (1) allow at least three feet of clearance between the vehicle and the bicycle; and (2) wait to return to the original lane until the vehicle is safely clear of the bicycle. Driver's license reciprocity with Germany. Requires the bureau of motor vehicles to begin negotiating with Germany not later than July 1, 2015, a reciprocal agreement for the exchange of driver's licenses.
Automated traffic enforcement images. Provides that an image produced by an automated traffic law enforcement system may not be shared with another state or a multijurisdictional information network.
Minimum crew size. Provides that the crew of a freight train must consist of at least two individuals. Imposes penalties for violations of the minimum crew requirement. Deposits the penalties in the industrial rail service fund.
Identification cards without a photograph. Requires the bureau of motor vehicles to issue a commercial identification card that does not bear the photograph of the holder and that is to be used for the limited purpose of commercial transactions. Requires that an application for a commercial identification card must contain a digital photograph of the applicant. Sets a fee of $11.50 for the issuance, renewal, amendment, or replacement of a commercial identification card. Makes technical corrections and corresponding changes.
Racial profiling. Prohibits a municipal, county, or state law enforcement agency from engaging in racial profiling. Requires a law enforcement agency to adopt a detailed policy that defines the elements of racial profiling. Requires a law enforcement agency to transmit to the attorney general information concerning racial profiling complaints, investigations, and any action taken, and requires the attorney general to submit a biennial report to the legislative council based on this information.
Learner's permit and driver's license examination. Requires the written part of an examination for a learner's permit or driver's license be in English. Prohibits an applicant from using a translator to take the written part of the examination.
Use of telecommunications devices while driving. Requires a person to use hands free or voice operated technology to place or receive a telephone call while operating a moving motor vehicle, unless the device is used to call 911 to report a bona fide emergency. Revises the term "telecommunications device" for purposes related to motor vehicle operation.
Environmental license plate fees. Provides that after December 31, 2015, the fee for registration of a vehicle for issuance of an environmental license plate may not include a supplemental fee of $10, used for the bureau of motor vehicles commission fund, the crossroads 2000 fund, and the integrated public safety communications fund. Makes corresponding changes.
